These terms govern your use of Kuulu, a marketplace where verified individuals across Estonia, Latvia, and Lithuania list and find second-hand goods, services, and other items. By creating an account or using Kuulu, you agree to these terms. If you do not agree, please do not use Kuulu.
1. Kuulu is a marketplace, not the seller
Kuulu provides a platform that connects buyers and sellers. Kuulu is not a party to any sale, does not own, inspect, or take possession of listed items, and is not the seller, buyer, importer, or distributor of anything listed.
Any contract for an item is concluded directly between the buyer and the seller. Kuulu is not responsible for the quality, safety, legality, or accuracy of listings, nor for the conduct of users, although we work to keep the marketplace trustworthy.
2. Who can use Kuulu
You must be at least 18 years old to use Kuulu. We confirm this from your verified identity at sign-in.
Every account is verified against a real legal identity using Smart-ID or Mobile-ID. You may hold only one account, you must give accurate information, and you may not use Kuulu on behalf of someone whose identity you are not entitled to use.
3. Your account and verified identity
Identity verification through Smart-ID or Mobile-ID is required to sell, and is what lets other users trust who they are dealing with. You are responsible for activity under your account and for keeping your sign-in means secure.
We handle your personal data, including your identity verification, as described in our Privacy Policy. We do not store your raw national identity code.
4. Acceptable use and prohibited content
You agree to use Kuulu lawfully and not to: list prohibited, illegal, counterfeit, stolen, or unsafe items; post sexual, hateful, harassing, fraudulent, or misleading content; impersonate others; scrape or abuse the service; or attempt to circumvent our safety, moderation, or rate-limiting systems.
We use automated and human moderation to enforce these rules. Listings or accounts that breach them may be held for review, removed, or banned.
5. Your listings and photos
You are responsible for your listings and must have the right to sell what you list and to upload the photos and text you post.
You keep ownership of your content. You grant Kuulu a non-exclusive, royalty-free licence to host, display, resize, and distribute your listing content as needed to operate and promote the marketplace, including in search results and notifications. This licence ends when you delete the content, except for copies we must keep for legal or safety reasons.
6. Buying, selling, and meeting safely
Because Kuulu is not a party to transactions, buyers and sellers arrange payment and handover between themselves. Take normal precautions: meet in safe places, check items before paying, and be cautious of deals that seem too good to be true.
Kuulu v1 does not process payments. Any future payment features will have their own terms.
7. Reporting, moderation, and your rights (Digital Services Act)
You can report a listing, user, or message that you believe breaks the rules or the law. We provide a notice-and-action mechanism and review reports through our moderation process.
If we remove or restrict your content, we will give you a statement of reasons explaining why, and you can contest a decision through the contact points in section 11. These commitments reflect our obligations under the EU Digital Services Act.
8. Liability and disclaimers
Kuulu is provided on an "as is" and "as available" basis. To the extent permitted by law, Kuulu is not liable for disputes between users, for the items or services exchanged, or for indirect or consequential loss arising from use of the marketplace.
Nothing in these terms limits liability that cannot be limited under applicable law, including your mandatory consumer rights.
9. Privacy
How we collect and handle personal data is described in our Privacy Policy, which forms part of your use of Kuulu.
10. Changes to these terms
We may update these terms as Kuulu develops or as the law requires. We will make the current version available here and, for material changes, give reasonable notice. Continuing to use Kuulu after a change means you accept the updated terms.
11. Governing law and contact
These terms are governed by the laws of Estonia, without prejudice to the mandatory consumer-protection rights you have in your country of residence.
