Terms of Service

These terms govern your use of Kuulu, a marketplace where identity-verified people across Estonia, Latvia, and Lithuania list and find second-hand goods and other items. By creating an account or using Kuulu you agree to these terms. If you do not agree, please do not use Kuulu.

1. Who provides Kuulu

Kuulu is operated by Berryfoot Brewing Co. OÜ (trading as Kuulu; registry code 16905016, address Tornimäe tn 5, 10145 Tallinn, Harju maakond, Estonia) — "Kuulu", "we". You can reach us at support@kuulu.ee, and for legal matters at legal@kuulu.ee.

Kuulu is a platform that connects buyers and sellers. We are not a party to any sale: we do not own, inspect, or take possession of listed items, and we are not the seller or buyer of anything listed. Any contract for an item is concluded directly between the buyer and the seller.

2. Who can use Kuulu

Kuulu is for adults: you must be at least 18 years old to use it.

Every account belongs to one real, verified person. You sign in with Smart-ID or Mobile-ID, you may hold only one account, the information you give must be accurate, and you may not use someone else’s identity or let someone else use yours.

3. Your account and verified identity

Identity verification through Smart-ID or Mobile-ID is what lets other users trust who they are dealing with. You are responsible for what happens under your account and for keeping your Smart-ID or Mobile-ID sign-in means secure.

We handle your personal data, including your verification data, as described in our privacy notice. We never store your national ID code in readable form — only an irreversible check code computed from it.

You can delete your account at any time from your account page. Deletion is permanent.

4. Buying and selling

Kuulu itself takes no payments and holds no goods: buyers and sellers agree on the price, payment, and handover directly between themselves. When you buy or sell, you deal with the other user — not with Kuulu.

Take sensible precautions: prefer meeting in person in a safe place, check the item before paying, and be wary of deals that look too good to be true, of requests to continue outside Kuulu, and of paying strangers in advance. Kuulu is free to use, and we never ask for payment in a chat.

If Kuulu one day offers paid features or payment processing, those will come with their own clearly stated terms.

5. Listing and content rules

List only items and services you actually have the right to sell, and describe them honestly. The following do not belong on Kuulu: anything unlawful to sell or own, counterfeit or stolen goods, items that are dangerous or subject to a recall, and anything that requires a licence or permit you do not hold.

The same honesty applies to behaviour: no fraud or misleading listings, no sexual or pornographic content, no hateful or harassing content, no spam or mass-posted duplicates, no impersonation, and no attempts to work around our safety, moderation, or rate-limiting systems.

Listing photos must show the actual item being offered.

6. Your content and the licence you give us

Your listings, photos, and messages remain yours. You must hold the rights to everything you upload.

So that Kuulu can work, you grant us a non-exclusive, royalty-free licence to host, display, resize, translate, and distribute your listing content as needed to operate and promote the marketplace — for example in search results, category pages, notifications, and as machine translations into Kuulu’s other languages. The licence ends when the content is deleted, except for copies we must keep for legal or safety reasons.

If you use the photo-based listing assistant, your photos are processed by AI services to suggest a draft — the privacy notice explains exactly what happens to them.

7. Reporting and moderation

Any signed-in user can report a listing or a user with the report button. A person on our team reviews reports. We also screen every new listing automatically before it goes live: photos are checked by an automated system and text is checked against known fraud patterns.

When something breaks these rules or the law, we act proportionately: a listing can be held for review (it is not visible while held) or removed, and for serious or repeated abuse an account can be restricted or banned. If several different users report the same seller within a short time, that seller’s listings are hidden automatically until a person has reviewed the account. A banned identity cannot register again.

Held listings and account-level review are shown in the “under review” section of your listings page; a banned account is told so at sign-in.

8. Contesting a decision (EU Digital Services Act)

If you believe a moderation decision was wrong — a listing of yours was held or removed, your account was restricted or banned, or a report you filed was declined — write to legal@kuulu.ee and say which listing or account it concerns. A person will review the decision, explain the reasons, and correct it if it was wrong.

legal@kuulu.ee is also our single point of contact for users and for authorities under the EU Digital Services Act (Regulation (EU) 2022/2065). You can write to it in Estonian, Latvian, Lithuanian, English, or Russian.

9. Liability

We work to keep Kuulu safe and running, but we provide it as it is: we cannot promise it is always available or error-free, and identity verification does not guarantee that every listing is accurate or every user honest.

Kuulu is not liable for the items, services, payments, or conduct of its users, or for disputes between users. To the extent the law allows, we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, and nothing takes away the mandatory consumer rights of your country of residence.

10. Privacy

How we collect and handle personal data — identity verification, the hashed national ID code, cookies, and your GDPR rights — is described in our privacy notice, which is part of using Kuulu. The link is below and in the footer of every page.

11. Ending the relationship

You can stop using Kuulu at any time and delete your account from your account page — deletion is immediate and permanent.

We can restrict, suspend, or terminate accounts that break these terms or the law, as described in section 7. You can always contest such a decision as described in section 8.

12. Changes to these terms

We may update these terms as Kuulu develops or as the law requires. The current version, with its date, is always on this page. For material changes we will give reasonable advance notice on Kuulu, and continuing to use Kuulu after a change takes effect means you accept the updated terms.

13. Governing law and contact

These terms are governed by Estonian law, without prejudice to the mandatory consumer-protection rules of your country of residence. Disputes are resolved in the Estonian courts, unless mandatory law gives you the right to the courts of your home country. You can also turn to the consumer-protection authority of your country.
